2.3.
Bij notariële akte van 29 augustus 2023 is de verdeling geëffectueerd. Evenals aan de andere erfgenamen werd een perceel grond van 767 m2 aan eiser toebedeeld. Daarnaast nog een perceel grond, dat ruim zesmaal zo groot was. In deze akte is onder andere het volgende opgenomen:
“Therefore, the appearers, hereby declare to carry out the aforementioned Agreement, in compliance with the aforementioned Verdict, in which the following immovable properties are divided as follows:

I. a parcel land in the district of [place], with an area of seven hundred sixty-seven square meters (767 m2) further described in certificate of admeasurement number [..] of two thousand thirteen (SXM CB 030/2013; Mr. [eiser];
J. a parcel land in the district of Cole Bay, with an area of four thousand six hundred eighty square meters (4680 m2) further described in certificate of admeasurement number [..] of two thousand thirteen (SXM CB 044/2013; Mr. [eiser];

Acquisition
The Properties derive from an immovable Property, originally having an area of (5.958 m2), further described in certificate of admeasurement number (SXM CB […]/[….]), hereinafter referred to as: (…) “the Original Land SXM CB […]/[….])”, which property was acquired by the late Mr. [naam erflater] (…)”.

The participants (…) declared that they hereby establish an easement of road in favor of the properties (…) (collectively referred to as “the dominant property”) and to the detriment of and burdening the remainder of the original land (SXM CB […]/[….]), constituting the right way with all means of transportation, for purpose of ingress and egress to and from the dominant property to [name road]. (…). A sketch with the aforementioned road (the servient property), currently known as the remaining land, (…).”.
